Before you (hereinafter referred to as "User") start reading and decide whether to accept the "PhotoSwift Terms of Service" (hereinafter referred to as "these Terms" or "PhotoSwift Terms") and pay to activate the PhotoSwift Service, please read the contents of this Agreement carefully. Minors under the age of 14 should read this Agreement carefully and decide whether to accept this Agreement in the company of their guardians, and purchase and use the PhotoSwift Service under the guidance and supervision of their guardians. • PhotoSwift Service Description

  1. PhotoSwift Service: It is a benefit provided to you by PhotoSwift that is exclusive to PhotoSwift. This service is a paid service and you need to pay extra for it. For specific benefits, please refer to Article 4 of this Agreement.
  2. PhotoSwift Service Rules: It refers to the terms, announcements, page descriptions and other contents related to PhotoSwift Service that PhotoSwift has or will publish from time to time in the future. The above contents will take effect once published and constitute an integral part of this Agreement.
  3. We may update this Agreement at any time based on our own judgment on business, legal and policy factors. Without your explicit consent, we will not reduce your legal rights under this Agreement.

• PhotoSwift Rights and Related

  1. Exclusive Materials: It refers to the materials and information provided by PhotoSwift that are already built into PhotoSwift or will be built into PhotoSwift in the future, including but not limited to filters, atmosphere, background, etc., which are limited to PhotoSwift for beautifying photos.
  2. Exclusive Functions: It includes exclusive functions provided by PhotoSwift that are already built into PhotoSwift or will be built into PhotoSwift in the future and are limited to PhotoSwift.
  3. Preferential policies: PhotoSwift may grant users who have opened or have not opened PhotoSwift at different stages preferential policies such as extension, rights upgrade, price reduction promotion, etc. according to the actual operation situation. The specific preferential policies shall be subject to the content of PhotoSwift's notification on the relevant service page. If you are a user who meets the above conditions, you are entitled to the above preferential treatment.
  4. PhotoSwift may make partial modifications to the above membership rights based on factors such as changes in laws, regulations and policies, and its own operating strategies, including but not limited to adjusting or delisting exclusive materials and exclusive functions, changing preferential policies, etc.

• Charges

  1. Charging method: For the paid services in PhotoSwift, you can complete the payment of membership fees through the IOS in-app purchase payment channel.
  2. Charging Standards: The charging standards are determined independently based on our operating costs, operating strategies, etc. (adjustments include but are not limited to promotions, price increases, etc.), and will be displayed to you on the relevant product service promotion and payment pages; if the relevant charging method changes during your purchase and renewal, the charging method actually accepted by us shall prevail; if the price of the relevant service is adjusted, it shall be based on the current effective price announced by us (unless we have otherwise agreed with you). Please read the relevant notice carefully before deciding whether to renew.
  3. Subscription Period: The subscription period is 1 week, 1 month, or 1 year, and users can choose.
  4. Automatic Renewal Rules:
    • Automatic renewal refers to the service launched on the premise that users have activated the PhotoSwift VIP service, based on the user's demand for automatic renewal to avoid failure to renew in time due to negligence or other reasons. If you choose to activate the automatic renewal service, PhotoSwift will issue a deduction instruction according to the deduction rules of the third-party payment channel when the subscription period is about to expire, and deduct the fees for the next billing period from the account without verifying the member account password, payment password, SMS verification code and other information.
    • PhotoSwift will automatically deduct the fee one day before the service expires. If the balance of your subscription account is insufficient to pay for the PhotoSwift service fee for the next period, PhotoSwift will make a second automatic deduction at irregular intervals on the day after the first automatic deduction fails. If the balance of your third-party account is still insufficient to pay for the PhotoSwift service fee for the next period during the second automatic deduction, PhotoSwift will automatically stop providing PhotoSwift VIP services. You will bear the risks and/or losses caused by insufficient deductible balance in the above account.
    • The automatic renewal deduction date is the day before the subscription period expires. Once the deduction is successful, PhotoSwift will activate the PhotoSwift service corresponding to this billing period for you.
    • PhotoSwift hereby reminds you that the amount of PhotoSwift service fees you pay for this billing cycle shall be based on the automatic renewal price agreed upon with PhotoSwift when you activate the PhotoSwift service. However, in the event that PhotoSwift carries out activities or other circumstances in which PhotoSwift has other agreements with you, the aforementioned amount shall be based on the relevant agreement between PhotoSwift and you. At the same time, if you activate the PhotoSwift service again after unsubscribing, the amount of PhotoSwift service fees you pay for this billing cycle shall be based on the automatic renewal price agreed upon with PhotoSwift when you activate the service again.
    • How to cancel automatic renewal: Open the "Settings" of your iPhone, enter "iTunes Store and App Store", click "Apple ID", select "View Apple ID", enter the "Account Settings" page, click "Subscription", and select "PhotoSwift" to cancel the subscription.

• Membership Regulations and Breach of Contract Handling

  1. During your use of PhotoSwift services, you shall not engage in the following behaviors:
    • Modify the service content, service period, consumption amount, transaction status and other information through technical means to obtain PhotoSwift services.
    • Providing PhotoSwift services to others for use (including but not limited to transfer, gift, loan, lease, sale, assignment).
    • Publishing, developing, transferring, selling, displaying, disseminating, synthesizing, creating derivative works, secondary creation, commercial development or promotion of the exclusive materials and customized functions provided by PhotoSwift services.
    • Crack, change, reverse operation, tamper with or otherwise damage any security measures and technologies of PhotoSwift services.
    • Obtaining PhotoSwift services through any illegal or improper means or exploiting loopholes or making malicious refunds.
    • Other acts that violate this Agreement, laws, regulations or regulatory policies and any infringement of the legitimate rights and interests of third parties.
  2. If you violate this Agreement, PhotoSwift has the right to make its own decision and may choose, in whole or in part, without prior notice to you, based on its own judgment or the needs of laws and policies:
    • Suspend or terminate your PhotoSwift service, take measures including but not limited to restricting, freezing or terminating PhotoSwift service, and you shall bear the consequences of the inability to use PhotoSwift service, and the fees you have paid shall not be refunded;
    • Appeal to administrative law enforcement agencies or judicial organs to pursue corresponding legal responsibilities. If any third party is damaged due to your violation of this Agreement, you shall bear the responsibility independently; if PhotoSwift suffers losses, you shall also compensate according to law.

• Interruption and Termination

If you have objections to PhotoSwift's modification of the content of this rule, or are dissatisfied with the service we provide, you may take the initiative to interrupt or terminate PhotoSwift service, including but not limited to failure to renew upon expiration and active cancellation.
